Key fob won't work at first, car has sleep mode?

When I first come out in the morning and use my key fob, none of the buttons respond/work. Trunk, remote-start, lock/unlock...

I have to take out the key, open the door, sets off the alarm, start the car, then the key fob works again no problems and from far away.

Brand new battery in key fob.

Seems like the car goes into sleep mode and doesn't respond the to fob until it's 'woken up'

Is this by design? or is there a trick to it?

door handle recall??? Not sure but doesnt sound right.. id call the dealer service and ask them if its reoccuring

Does not sound right to me and since it is a 2009 it is not a door handle issue.

Key FOB Issue

Hey madcoder, did you ever get your key fob issue resolved. My 2009 started doing the same thing a few days ago, just curious before i head to the dealer.

Sorry I never updated this post...

I put ANOTHER new battery in it and it worked just fine after that, not sure why.
