Suspicion of a tune? How about they prove it had a tune! There needs to be some sort of process to arbitrate such things, not just the conflict of interest manufacturer who'd have to shell out.

As soon as the dealer plugs into the car, they can see very quickly all that has been flashed to the pcm.

FCA can dig a little deeper and find out even more.

They take this tuning stuff seriously, why wouldn't they.

Pretty simple, they didn't lock the pcm's just for the heck of it.

He didn't say they detected a tune, but that there was a suspicion of a tune. Quite different if correct. A Guy

It appears that all the details aren't clear yet. What did the dealer really find? Is FCA digging deeper to verify the "suspicion of a tune?" How good or what's the dealers reputation?

A little too foggy of facts to say exactly what's really going on.

Any denial of warranty will be put in writing as to why it's being denied.

No next step until then.

Fact is, the mfr has to PROVE the tune or whatever evidence they have caused the failure.

You can indeed take this warranty denial to arbitration for FREE!

Gather your evidence that any mods did NOT cause the failure, or hire an auto expert to speak on your behalf.

Look for common issues called "Known Product Failures", like mds valve-train failure causing the valve to damage the piston. Show it happens w/o mods, therefore FCA should pay.

No guarantees, but it works all the time. It's FREE!

Really, the evidence is in the pcm. If it's been altered after being sold, and a tune installed, FCA has the right to deny warranty claim. It's in writing already and clearly stated.

The owner will have to have deep pockets to fight FCA on this and win.

Very, very long shot to win this.

Need more info.
Did you buy the car new or used.
If new did you flash the ECU. If yes, you are screwed. If no, then they are full of poo
If used, its possible the previous owner did flash the car.

Id ask them to show you the evidence that there even was an aftermarket calibration. Make them show you the P1400 code in the PCM. If there is no P1400, then it the PCM wasn't touched. That code gets thrown when you modify the car with an aftermarket calibration. As of fairly recently, it cant be removed or tuned out or masked. (though Im sure people are working on it).

I dont think anything else causes that code.

If Previous owner flashed it and an FCA dealership sold you the car without telling you the warranty was voided, you have a case.

The OP knows if there was a tune, right?. If there was a tune, and that violates the conditions of the warranty, this is pretty much an open and shut case.
