I'm a red light, Cop approaches behind me.

Coming home from work say about midnight. A soon as the light turns green, I barely pressed on the gas but car still took off first as compared to others on my side, not a big difference or nothing bad at all.... 5 seconds later, Cop puts the lights on me. I pull over. Bright light from their side mirror blinding me. Two cops come, one at each side and ask me why I'm driving like an *******.
I say confused I'm not. He responds with an okay, after handing him the license and registration he goes back to his car and comes back with a ticket for careless driving, I ask what did i do? He says on the red light i made my wheels squeal. Didn't argue, but I know this carries a 2 point on my license being my first ticket, I can pay $400 or so in court to get it taken away but I find it so unfair and such attitude he had towards me.... next day I tried to recreate the problem and see if my wheels really did squeal, and I have taken off faster, slower... I even held on the brakes while pressing on the gas and letting the rpms go up to 3-4 and nothing, the car takes off but at any moment do the wheels squeal...

What bothers me the most is the unfairness of the ticket and how rude they can be.

They were just jealous of your car.

If you fight it in court you need to let it be known about the drive by wire feature of these cars and how the delay is between pushing foot down and car actually moving.

i dont even know about that, but im researching it now.

But on the other hand, is it even worth it? do you ever win such cases, my court date is the 7th but not unless they dont show up do i feel i can win.. I mean two COPS against my word?

Sure, it's worth it. Many times the cops don't even show. Also, with law they need to prove you were driving wreckless. Do they have video? Just like when you get a speeding ticket, if done by radar there has to be a certificate within a certain period of time stating the instrument is reading accurately.

I'm sure part of it may have been your car, part your age, but if it went down exactly like you say, the cops are the ******** here.

I'm sure they are under pressure to write as many tickets as possible. Localities are under tremendous financial strain during this recession because of loss of sales tax revenue, states cutting funding, etc. Many (at least in my area) are using traffic tickets to help balance their budgets.

I would think you could fight this and win, but it will take a trip to court. If you defend yourself, make sure you dress appropriately (minimum khakis, dress shirt, tie), shave and comb your hair and practice what you're going to say before you get to court. Use good grammar, don't interrupt when the police are speaking, just be polite and articulate in stating your case. I think you'll do fine.

Sorry to hear about that man. Unfortunately, this car attracts good and bad attention. Especially power tripping and jealous Camaro owning cops.

My wife got two tickets in the same month,driving her minivan.I convinced her to show up in court and she did.Both times the cops never showed up and the tickets were dropped.
Then I just can't resist the sounds and smells of a burnout in my RT,so it happens often.The cops have never caught me [yet].
But to make you feel better,my brother in law who is a traffic magistrate,tells me that if someone takes the time to show up in court and acts pleasantly he lets them off with a warning or reduced charge.

If it doesnt look like its going to go your way in court tell the judge you have no problem paying the fine but would they please refrain from attaching the points to your license. At least its something and your insurance will not be affected.

Plead not guilty. Go to court. Its a pain, but you will probably be able to save the points on the license by pleading to a lesser charge. You will still have to pay though. I my area it works like this:
1) Plead not guilty
2) They send you a court date or what they call a "consultation date" in the mail.
3) You show up to the court date along with 200 other people.
4) You wait for the accusing officer to call you name.
5) When he does you make a deal to plead guilty to a lesser change.
6) You go before the judge with the cop and make the plea.
7) They collect money from you.

Similar thing happened to me about a year ago but my ticket was for laying drags, I took it to court and had the fine reduced, but the judge wasn't letting anyone off that day. It's always worth it to go to court, especially as your first offense the judge will probably lower it so it won't leave the county or city and you won't get points.

Thanks for the Suggestion, i guess i might just go to court but i'm ignorant on how this all works. On my Ticket it says i have court the 7th.

Do i have to notify anyone im going? is there anything i have to do as of now before the court date on the ticket. is there a reason why the cop instead of putting 12:30+ at night wrote 11:59?

I just hope he doesnt or they dont show up as it will be much easier for me. But in case they do ill plead not guilty, and at the worst case scenario just accept to pay a fine to not get any points because of insurance...

Its just that i don't want to mess up when i'm talking, like i don't want to sound rude, or sound wrong to the judge where he will dislike me. im just nervous i guess since ive never been through anything like this

And it's not driving like an ass, these cars have so much torque it doesn't take any effort to do it, any wetness or gravel and they'll spin every time unless you roll 10ft before accelerating.

I have only gotten one ticket in mine, doing 72 in a 60... along with a half dozen other cars, most of which were going faster, but I was the orange one in the group. I took defensive driving, is that or something like it an option where you live? You'll have to pay court costs, $150 or so here, buy the course online for $25 and it keeps it off your record.

And it's not driving like an ass, these cars have so much torque it doesn't take any effort to do it, any wetness or gravel and they'll spin every time unless you roll 10ft before accelerating.

I live in New Jersey. And What Course - can you direct me on how to do it and the validity of this because id definitely do it, i'm willing to spend the money required to get this fixed. im just NOT HAPPY about it. & i believe my sister a year ago paid almost $500 on her first ticket for speeding i think 5-15 over so it wouldnt go on the record. but we dont talk:/ so cant get info from her.

I will agree that you should go to Court. But first,I would goo to the DA's office and ask one of their employees, who prosecutes traffic violations. See if you can explain to them what happened, if he or she does not want to hear what you lhave to say. then ascertain the proceedures for Court appearance. Ask if the Judge or Traffic referee rules against you, can you go to traffic school. I don't know what state you live in or if traffic school is available. If so, the citation won't show up on your record so there won't be any points added and it won't go to your insurance company. I worked in Calif. and our judges were strong advocates for traffic school. Here in Alabama where I am retired, the DAl's office checks your record and recommends traffic school if you have a good record.
I have been to traffic school, 4 hrs one evening and case dismissed. Good luck to you.
I might add, you recieved the citation that many of us should have gotten.

I would take the matter to court, as you have nothing to lose. However, do not count on the police officer failing to appear. The only reason a police officer or state trooper may not appear is if he or she is on vacation or ill. If an officer fails a court appearance they are admonished by their Sergeant and/or supervisor.

A note to all: When you are pulled over for a vehicle code infraction the less you say and become upset the better chance you will have in court. The very moment you start to run your mouth the officer will pull out his ball-point pen and begin to take detailed notes of the incident on his copy of the citation which he will then refer to in court and submit as evidence. Also, local jurisdictions are lucky if they break even on vehicle code citations. They are NOT a revenue source or "money-maker" for cities or counties like everyone believes.

i am friends with the town justice where i live.they do in fact raise revenue.

Do the local cops use dashboard video cameras? If so, cold you ask for a review of the video to see whether or not you squealed the tires or in any other way acted recklessly? They wouldn't hesitate to pull out the video if they needed it to prove they're right. There's no reason you shouldn't be afforded the same chance to prove your innocence.

Oh man I have a cousin who lives in New Jersey, I've visited him there 5 times in my life, and 2 of those we had run ins with the cops. The worst was when they pulled us over for being the only car on the road after 10pm(we were out for food), they searched his car and actually confiscated his mini Yankee bat he'd had since childhood! No citation as he wasn't speeding or doing anything wrong. From that, and what he tells me the cops there are complete ********

There should be information about "defensive driving" on the ticket. If not Google Defensive Driving in New Jersey. Here's how it works in Texas anyway; You need to write to the court, or show up at the court and request permission to take the course. If there is no info on the back of the ticket, I would call the court house and see what they say about it. Once granted there are many online DD courses you can take that take 5-6 mind numbing hours, go at your own pace. You also need to get a copy of your driving record from the DMV, the court can provide info on how to get it in NJ I would think.

In Texas, doing that keeps the violation off your record, but you can only take the course once a year. Plus you can send the completion certificate to your insurance company to save $$ on your insurance. :)

EDIT: Nevermind, I just did a Google search for you, and completing the course does help with insurance, but it's a 2 point deduction from your licence anyway. :( Although it would be cheaper than paying the full fine. Glad we don't have that point crap here in TX. I'd fight it in court.

typically there's a pre-trial 1st...show up...tell them your story...for 2 points ill bet they drop it

i had a speeding ticket (6 points) a few months ago...i got it dropped to 2 points and they called it something other than speeding to help my insurance...i didnt have to argue or even speak...you went into a room and they offered it to you....

if you didnt do it you cant just take it.....cops are human too and make mistakes...they can also be a-holes too

I hate this kinda stuff. I am a Major Crimes Detective, retired. I was, in my 25 yr career, a Traffic Enforcement specialist on Bikes and unmarked units and a Traffic Prosecutor before being promoted to Detective
That being said, this kind of action, and we are taking your word for the facts, is plain over use of authority..now to the fix..

Bear in mind what TommyGNR says...Additionally,If it is your 1st appearance, Dress neat with a suit and tie...it puts you on an even keel with the Judge. Plead not guilty..in addition ask "with respect your Honor may I have access to a copy of the dash cam video from these patrol officers camera". Additionally,Get youself a copy of the Traffic act with the section you are charged under..e mail it to [email protected]

My guess is if it is Careless Driving, they have to prove more than one Traffic violation...if it is "Stunting"..then the spinning wheels is an easy ticket for them as a 2 to 1 evidence ratio....
When you get the section and e mail it to me I will give you a course to take to get the best chance of beating this crap! Your Defence.. WILL INCLUDE THE DOCUMENT REGARDING THE DELAY FEATURE..get hold of this information so you can present it at the right time to the prosecutor and Judge..and not before! I will tell you when and how.

Most Cops are just other guys like you and me. It just pisses me off severly when you get stories about idiots like this that bring the Uniform into disrespect!
Let's see what we can do to even the odds!!
